Software License Descriptions
Following are descriptions of the various types of software licenses that may be available for this product in your market (See Pricing — Software License above for options).
Individual/Home License:
This type of license is for one individual's personal use only. It allows for one registered owner to use the software on a single computer at one time.
SEAT License:
This type of license grants you the right to use the Software at the same school or organization at one physical address location under either a PERPETUAL or SUBSCRIPTION License. The number of seats purchased determines how many computers may run the Software concurrently (at the same time). If the Software includes multiple programs or resources, the seat limit applies to all items collectively. For example, a 10-Seat License allows for the Software to be run on up to 10 computers at the same time. In this example, the Software may be installed on a network, or installed on more than 10 computers, but the Software (including any of its individual programs or resources) may not be run on more than 10 computers concurrently. Individual Seats cannot be shared among different schools or organizations.
SITE License:
This type of license grants you the right to use the Software on all your school's or organization's computers at one physical address location under either a PERPETUAL or SUBSCRIPTION License. There are no limits on how many computers may run the Software concurrently (at the same time) — as long as they are on the same site (one physical address location). A SITE License cannot be shared among different schools or organizations.
PERPETUAL License:
This type of license grants you the right to use the Software at the same school or organization at one physical address location in perpetuity (forever).
SUITE SUBSCRIPTION License:
This type of license grants you the right to use the Software at the same school or organization at one physical address location for a limited period of time ("Subscription Period"). The Subscription Period starts on the date you use your GOVENTURE KEY to gain access to download the Software. The Subscription Period ends (expires) on the date on which your purchased Subscription duration has passed. Your subscription must be renewed prior to expiration in order for you to continue to use the Software. If you do not renew your Subscription, your school’s or organization’s right to use the Software and resources included with the Subscription shall cease as of the expiration date. You agree to promptly stop using, uninstall, and destroy the Software and related materials included with the Subscription, and to promptly notify MediaSpark in writing that all of these actions have been taken. Failure to do all of these actions no later than 2 weeks after the expiration date will result in the automatic renewal of your Subscription. You may choose not to renew your Subscription once your prepaid or preordered Subscription period has expired, but activated Subscriptions cannot be cancelled for full or partial refund.
Lab-Pack:
This license is for post-secondary educational institutions that wish to own the software and continue to reuse it with different students. Under this option, there is no cost for the students to use the software. This license allows for many people to use the software at the same organization (school) at one physical address location. The number of seats purchased determines how many computers may run the software concurrently (at the same time). For example, a 5-Seat License allows for the software to be run on up to 5 computers at the same time. In this example, the software may be installed on a network, or installed on more than 5 computers, but the software may not be run on more than 5 computers concurrently. Individual Seats cannot be shared amongst different organizations (or schools).
Student-Pack:
This license is for post-secondary educational institutions that do not wish to own the software and instead prefer that students purchase and own the software. Under this option, every student using the software would have to own their copy. This license consists of two licenses: 1) A 1-Seat License or Online User Subscription for the Instructor, and 2) An Individual/Home License or Online User Subscription for each student who purchases the software. One CD or Online User Subscription is provided with the Instructor's license and one with each license purchased by a Student. ONLINE Subscription:
“Learner-Managed” Online User Subscriptions — Applies to the following licenses: Home/Individual, Education Postsecondary, Nonprofit, Government, and Business licenses. This license allows for one person to be assigned access to the software for a given period of time — the duration of the subscription. The software is accessed via the Internet. Using a computer with Internet access, a subscriber can use the software at any time and as often as desired, as designated by the license, until the subscription expiration date. A subscription cannot be shared or reassigned — each person wishing to use the software must have his/her own subscription, which includes a unique username and password.
“Instructor-Managed” Online User Subscriptions — Applies to Education K12 licenses: This license allows for one or more Instructors at the same School to share a Subscription and be assigned access to the software for a given period of time – the duration of the subscription. Based on the number of Student Accounts purchased, and as assigned by the Instructor(s), the software may also be accessed by Students registered at the same School as the Instructor(s). The software is accessed via the Internet. Using a computer with Internet access, a subscriber can use the software at any time and as often as desired, as designated by the license, until the subscription expiration date.
